SA consumers burdened with debt: SAHRC

Over half of South Africa’s credit active consumers are over-indebted, and micro-lending negatively affected many in poorer communities, the SA Human Rights Commission (SAHRC) said on Wednesday.

As a result, more than 11m of South Africa’s credit active consumers were described as over-indebted. This high level of indebtedness was compounded by South Africa’s low level of savings.

He was addressing a SAHRC discussion on business, human rights and the implications of micro-lending on access to justice. Historically in South Africa, the poor had been unable to get loans since they had no assets as security. “For persons living in poverty, loans were not available as a means of lifting oneself out of the confines of poverty,” Singh said. Micro-lending had since enabled the poor to access cash. “What we are seeing in South Africa and other parts of the world, even in the US and UK, is that these [micro] loans are being used for consumption,” Singh said. “From 2007 to 2012, in South Africa we saw outstanding unsecured credit increase from R41 billion to R159bn, a growth of 60 percent.” With a faltering economy, cash-strapped consumers were struggling to pay back loans, and getting trapped in a poverty cycle and debt trap.

WHAT is DEBT REVIEW?
Debt Review is a process in terms of the National Credit Act for over indebted consumers, who are struggling to keep-up with debt repayments and/or manage their finances. The purpose of the act is to protect the over indebted consumer against Credit Providers.
Some Credit Providers grant credit to consumers who cannot afford it - therefore consumers need to be protected against such indiscretions.


The National Credit Act (NCA) introduced the formal debt rehabilitation program - debt review, in order to prevent consumers from being placed under personal administration.

The process was also implemented in order to ensure that debt counsellors follow legal and ethical guidelines when assisting clients with obtaining financial well-being.

The vast majority of consumers in South Africa use an estimated 78% of their monthly income on debt payments. This is NOT a healthy situation for anyone to be in.

The debt review process was introduced in 2007 with the National Credit Act (NCA). The benefit is that, while you’re getting debt counselling and in the process of paying-off your debts, legal action can’t be taken against you, and your assets cannot be sold or attached.

Bear in mind that you can only take advantage of this process if you have a regular income to develop a reasonable repayment plan.

The PROCESS (in short)
* A prospective client’s debt situation will be assessed FREE of charge - to ensure that they are in fact over-indebted and qualify for debt review / counselling.
* Client completes a Form 16.
* A re-structured debt-repayment plan will be drafted and negotiated with Credit Providers, and implemented to FIT your individual POCKET, via a legal court application and order.
* Interest rates and repayments with credit providers are re-negotiated in order to reduce payments (by up to 60%). In many cases interest rates on debt repayments are dropped to [zero] percent. Clients thus ONLY repay capital. This process also includes extending debt repayment terms.
* A new affordable monthly budget and payment plan are implemented, which will provide the client with appropriate guidelines and means to live by.
* We assist you for the duration of your debt counselling period, reviewing your circumstances regularly.
* We rehabilitate the status of your credit profile.
* We offer you legal protection from all your Creditors. They cannot harass you any longer.
* We issue you with a certificate of clearance at the end of the process.

This entire process ensures that the client makes only one monthly debt re-payment to a payment distribution agency - which will then pay all credit providers on behalf of the client. This substantially reduces the stress of having to keep up to date with multiple debt repayments.

The Process reviewed (after client agrees to debt review) . . .
- An application form (Form 16) is completed.
- Client is flagged on all the national credit bureaus as being under review.
- A Notice will be sent to all Creditors and Credit Providers advising them of your application.
- Budget and Payment Plan are based on affordability.
- A proposal will be sent to all Creditors confirming the negotiated amounts.
- A Court Application is prepared and presented to a Magistrate/Tribunal within your jurisdiction.
- The Court Application is granted and a court order issued (clients don't appear in court).
- All payments are maintained by a PDA (a NCR accredited Payment Distribution Agent) and  managed by a Registered Debt Counsellor - for complete peace of mind.

WHO should consider DEBT REVIEW?
If your monthly repayments on your house, car, credit cards and other accounts/installments have risen so high that you’re facing possible legal action and/or blacklisting - it would be advisable to consider debt counselling or debt review. We advise clients to apply for debt review when they are two payments in arrears, and before credit providers start threatening with legal action.  

BENEFITS of DEBT REVIEW . . .
One (1) fixed and affordable monthly re-payment
One of the biggest benefits of debt review is that you will only have to pay one payment, which will be spread to cover all your debt repayments with your creditors. This will mean that you will have MORE cash flow every month to use for life-important expenses, like water & electricity, groceries, fuel, school fees, etc.

No more calls and harassment from Creditors
Once you've registered for debt review and your application was successful (meaning that you are over-indebted), creditors cannot phone to harass you any longer. Your debt counsellor will take over that responsibility for you and allow you to have peace of mind regarding your debt repayments.

Your assets are protected
Creditors cannot exercise their right to attach your assets or sell any of your assets, once you are under debt review (except in cases when a specific debt falls outside of your debt-review plan).

No Blacklisting or Judgments (once you go under debt review)
Another big benefit is that the NCR protects you from being blacklisted.

By going under debt review, you give yourself the opportunity to recover from financial over-indebtedness, enabling you to restore your financial status, empowering you to apply for credit again once your debt is paid off.
